Anegbe, who resides at No. 45, Ifelodun St., Fatolu in Ipaja, near Lagos, is facing a two-count charge of defiling and indecent assault at an Ebute Meta Chief Magistrates’ Court.
The Chief Magistrate, Miss S.O. Solebo, said that the accused should be kept behind bars, pending an advice from the Lagos State Director of Public Prosecutions.
The Prosecutor, Insp. George Nwosu, told the court that the crime was committed on Jan. 27 at about 2.30 a.m.at Anegbe’s residence.
“The accused, his wife and the victim live together in a room apartment. “The accused said that he heard a voice that he should have sexual intercourse with his daughter before he can be successful. “He forcefully slept with his daughter when she was six years old and his wife caught him but forgave him. “On the fateful day, he took the victim to his bedroom because his wife was not around and ordered her to pull-off her dress and forcefully had sexual intercourse with her. “The wife of the accused saw them and reported the case to the police." Nwosu said.
He noted that the offences contravened sections 135 and 137 of the Criminal Law of Lagos State, 2011. If found guilty, the accused may be sentenced to life imprisonment. Counsel to the accused, Mr O.O Adeyemi, urged the court to grant the accused bail but the chief magistrate refused him bail, citing Section 264 of the Criminal Law.
The case was adjourned to April 4, for mention.
